As Serbia advances in aligning with international safety standards and sustainable energy goals, particular attention was given to institutions such as SRBATOM, the Vinča Institute of Nuclear Sciences, and other relevant regulatory and environmental bodies. Through a comparative analysis, the paper identifies areas requiring additional investment, technical expertise, and greater public engagement, emphasizing sectors that call for strategic approaches and reforms in the coming years. The article starts from a Federal Court of Australia ruling, in which Qantas Airways was fined AUD 90 million for the unlawful dismissal of more than 1,800 employees during the COVID-19 pandemic and the subsequent engagement of external contractors for their roles. This case, the largest of its kind in Australian history, highlights the serious risks that arise when redundancies are followed by the outsourcing of the same positions. From a Serbian perspective, the article reviews relevant provisions of the Labour Law and analyses two recent court decisions. The Supreme Court confirmed the employer’s right to organize work through external service providers, while the Court of Appeal in Belgrade emphasized that re-employing staff in the same roles shortly after dismissal may constitute an abuse of rights. The event brought together numerous representatives of member companies and was an opportunity for a detailed analysis of key aspects of employment relationships - from establishment to termination, with a special focus on the engagement of foreign nationals and directors. We would like to thank the Chamber of Italian Serbian Businessmen as well as the company Heads Adriatic for the initiative for this great joint event.   - [Approaching Deadline for Compliance with the new Law on Safety and Health at Work](https://d2plaw.com/en/d2p-headlines/approaching-deadline-for-compliance-with-the-new-law-on-safety-and-health-at-work/): The previous Law on Safety and Health at Work from 2005 stipulated the employer's obligation to insure employees against work-related injuries and occupational diseases, in accordance with a special law. However, as the special law regulating this matter was never adopted, the subject provisions remained without significant practical impact in the previous period. On 7 May 2023, the new Law on Safety and Health at Work ("Official Gazette of RS", no. 35/2023) (the “Law”) came into force, that retained the obligation for employers to insure employees, referring to general insurance legislation. Compared to the previous law, the new Law prescribed a monetary fine for the employer if it failed to insure its employees against work-related injuries and occupational diseases, in the amount of up to RSD 1,500,000 for the employer, i.e. up to RSD 150,000 for the responsible person within legal entity. According to the Law, employers are required to insure employees against work-related injuries and occupational diseases, with funds from their own resources, to ensure compensation for damages. In addition, the representatives of the Occupational Health and Safety Administration and the Labor Inspectorate on several occasions confirmed that employers now must insure their employees against work-related injuries and occupational diseases. Employers are obliged to organize their operations in accordance with the new Law within two years from the date of entry into force, including the obligation to insure employees. Therefore, employers should comply with all provisions of the new Law by 7 May 2025 at the latest.   - [RES Serbia and D2P organized an Energy-Legal Breakfast](https://d2plaw.com/en/d2p-headlines/res-serbia-and-d2p-organized-an-energy-legal-breakfast/): What are the most important amendments to the Energy Act for the sector of renewable energy sources? Which novelties bring other laws in the field of environmental protection? What do the amended EU regulations on sustainability reporting mean (Omnibus package)? These are just some of the issues that were discussed at the Energy-legal breakfast organized by the Association of RES Serbia, in cooperation with the associated member, the law firm Drašković Popović & Partners, at the premises of the law firm. Those present were greeted by the organizers, the manager of OIE Serbia, Danijela Isailović and the senior partner in D2P, Uroš Popović, emphasizing the importance of legal certainty for the further development of the sector of renewable energy sources. Milica Pešterić, a partner at D2P, presented all the important amendments to the Law on Energy, which were adopted at the end of November 2024. Those present were able to get better acquainted with the terms defined by this law, such as active customer, energy community of citizens, as well as other changes and additions to the law that are very important for the entire RES sector. Also, Milica referred to the whole process and results of the first two rounds of auctions, as well as what can be expected at the next auctions. After a detailed review of the legislation of the Republic of Serbia in the field of energy, Tina Petrić, associate at D2P, presented the new legislation in the field of environmental protection. In addition to the review of international agreements and EU regulations to which the Republic of Serbia has committed itself in this area, Tina also clarified the novelties reflected in the Low Carbon Development Strategy, INEKP, various programs (especially in the area of ​​the circular economy), as well as the Energy Development Strategy until 2040, with projections until 2050. The event concluded with an overview of the amended EU regulations regarding sustainability reporting, i.e. ESG reporting. The Legal 500 Europe, Middle East & Africa 2025 is now available to view online here.   - [Serbia: New Law on Central Registry of Beneficial Owners](https://d2plaw.com/en/d2p-headlines/serbia-new-law-on-central-registry-of-beneficial-owners/): On 6 March 2025, the Assembly of the Republic of Serbia adopted the new Law on Central Registry of Beneficial Owners (the “Law”). The new Law entered into force on 14 March 2025, however its application has been delayed in order to provide sufficient time for business subjects to achieve compliance with the new obligations. The goal of the changes introduced by the new Law is to have more transparent and reliable records of the beneficial owners. Key Novelties One of the key novelties is the obligation to submit the documents based on which the UBO was registered as such. Further, there will be an obligation to regularly review the registered data and update them, if necessary. The deadline for the UBO registration has been prolonged – it is now 30 days from the date of the registration of a business entity or change of the ownership structure in the business subject. The Law envisages the duty of banks (and other obligors) to review the documents and data registered in the UBO register and compare them with data and documents they separately obtained. The Business Registers Agency (the “BRA”) remains as the authority in charge of monitoring the implementation of this Law, with a new, additional obligation. Namely, after 60 days from the date the Law becomes applicable, the BRA will publish a list of business subjects that have not registered/submitted required data and documents concerning their UBO. The penalties for breaching the Law are the same as they were in the previous law – ranging from RSD 500,000.00 (approx. EUR 4,300.00) up to RSD 2,000,000.00 (approx. EUR 17,000.00). This is a major step forward in creating a more favourable business environment to help EU companies grow, innovate, and create quality jobs. These first ''Omnibus'' packages, bringing together proposals in a number of related legislative fields, cover a far-reaching simplification in the fields of sustainable finance reporting, sustainability due diligence, EU Taxonomy, carbon border adjustment mechanism, and European investment programmes. Key Novelties The proposals will streamline EU requirements for all businesses, with a particular focus on reducing the burden on SMEs. By prioritizing regulatory obligations for the largest companies - those with the greatest environmental impact - the framework ensures a more targeted approach while still allowing businesses to access sustainable finance for their green transition. The package includes amendments to the Corporate Sustainability Reporting Directive (CSRD), the Corporate Sustainability Due Diligence Directive (CSDDD), the Carbon Boarder Adjustment Mechanism (CBAM), and the InvestEu Regulation. The package is accompanied by a draft Taxonomy Delegated Act for public consultation. The mentioned amendments cover steps to: Make sustainability reporting more accessible and efficient; Simplify due diligence to support responsible business practices; Strengthen the carbon border adjustment mechanism for a fairer trade; Unlock opportunities in European investment programmes. Application The proposals will further be submitted to the European Parliament and the Council for their consideration and adoption. In its work programme for 2025, the Commission announced a series of measures to address overlapping, unnecessary or disproportionate rules that create barriers for EU companies. Collectively, with these measures, the Commission wants to reduce administrative burdens by 25%, and by 35% for small and medium-sized businesses, by the end of its mandate in 2029. Key developments for 2025 in Serbia: Termination before end of the probation period: Case law update Health and safety in the work place Amendments to immigration laws Top 3 Global Trends for 2025: Raising the Bar on Workings Conditions and Employee Wellbeing As we look out this year at what is in store, we see a myriad of new laws and proposals aimed at improving working conditions and employee wellbeing. This ranges from the traditional, with new health and safety laws, to increased family friendly leaves and new protections related to women’s health, to improved sick leave rights and protections, and greater recognition in law for remote and agile working practices. We also see wider recognition of the right to disconnect, and new proposals to reduce working hours. There are new laws to tackle harassment and bullying, and various gender and race equality laws, and more reporting on compliance with disability quotas. We see the EU take action by passing the Platform Workers Directive in November 2024 (it must be implemented by December 2026), and some non-EU governments debating new laws aimed at establishing minimum protections for platform workers. These efforts to raise the bar for all and improve employee wellbeing will be welcomed by many global employers. This trend may be a response to the post pandemic world and recognition of the fiscal and societal benefits of a healthier, productive and regulated working population for governments. However, we also see the influence of increasing global awareness and recognition of environmental, societal and governance issues, and reporting obligations on sustainability, equality, working conditions and human rights. Pay Under Scrutiny The thorny issue of pay is a continuation of one of the key trends from 2024, perhaps reflecting the on-going economic challenges that so many jurisdictions continue to face in 2025. Given the obvious correlation between an increase in wages, increased social security costs, and benefit and severance costs linked to salary, employers now face an even heavier burden. This year  the increase in the national minimum wage is a key issue. The EU Pay Transparency Directive, which must be transposed into the national law of EU member states by June 2026, sees some EU member states drafting legislation to transpose the Directive in 2025. Aside from greater transparency around pay, it will require employers with 100 employees or more to consider the very technical “work of equal value” concept and publish any gender pay gap for all to see (the first reports, for those companies with 150 employees or more, will be due from June 2027). Similar pay transparency initiatives have been seen in the United States with the introduction of new laws requiring employers in 14 states (including New York and California) to disclose pay scales or ranges and other benefits in both internal and external job advertisements. Therefore, we will see increased pay scrutiny in 2025 on a global scale. The Era of Widespread Adoption of AI AI is a mega trend, rather than a key trend for 2025, but whatever it is called, it cannot be ignored. This year, we will see more on the race for supremacy amongst jurisdictions such as the US and key stakeholders, such as the EU, to lead the world in responsible AI. Meanwhile, on 1 August 2024 the EU AI Act 2024 came into force for the 27 EU member states. It has extra-territorial effect in certain situations, plus hefty sanctions for breach of up to €35 million or 7% of annual worldwide turnover in cases of high-risk AI systems. Therefore, even non-EU businesses need to prepare themselves for when this comes into effect in August 2026. We also anticipate that the EU Act will do for AI, what GDPR did for the privacy laws around the globe. Therefore, as we see the era of widespread adoption of AI in the workplace, we also know that employers need to prepare for the potential legal challenges that will inevitably follow. One of the main objectives of the amendments and supplements to the Law on Energy is to adopt provisions of European regulations that Serbia is obligated to transpose. Key Novelties Lifting the Moratorium on Nuclear Power Plants: Enables the development of nuclear energy in Serbia, including monitoring global advancements in nuclear technologies. The Ministry of Mining and Energy will manage the stages of nuclear energy development, including the feasibility assessment and sources of financing. Abolition of Net Metering for Households: Net metering for prosumers will end on 31 December 2026, but existing prosumers will continue using it for the lifetime of their solar plants. Dynamic Tariff Contracts for Consumers: Customers can now sign supply contracts with variable electricity prices based on market changes. Household and small customers can access an app to compare electricity supplier offers. Introduction of "Active Customer" Status: Businesses or groups who generate, store, or sell electricity independently can now participate in energy flexibility markets and ancillary services. This status helps decarbonize the economy, manage CO2 emissions, and secure green energy supplies. Power Purchase Agreements (PPAs): Active customers can secure PPAs to decarbonize and avoid CO2 taxes, both locally and when exporting to the EU under the Carbon Border Adjustment Mechanism (CBAM). New Energy Activities: New activities such as aggregation and the production/trade of unconventional fuels are now included. Licensing for Energy Activities: A new license is required for electricity storage; Foreign entities can apply for electricity supply licenses starting 31 December 2028, subject to conditions. Energy Permit Exemptions: Exemptions for energy facilities under public-private partnerships, strategic renewable energy partnerships, and those for personal electricity use. Energy Permit Conditions: New conditions for energy permits include compliance with national energy strategies, feasibility of construction on exploration fields, and alternative solutions for electricity generation. Certification of Renewable Energy Installers: Introduction of certification for installers of renewable energy systems. Hydrogen Development Strategy: Plans to adopt a strategy focusing on hydrogen production, transport, storage, and use to reduce greenhouse gas emissions. Application The Law on Amendments to the Energy Law came into force on 6 December 2024. With the entry into force of the amendments, the Law on the Prohibition of Nuclear Power Plants in the Federal Republic of Yugoslavia ceases to be valid. To remind, this law prohibited the construction of nuclear power plants and was adopted in 1989, three years after the nuclear disaster in Chernobyl, Ukraine, which was then part of the Soviet Union. In this regard, we would like to remind you that the Minister of Mining and Energy signed a Memorandum of Understanding in July on the development and application of nuclear energy with representatives of five ministries and 20 universities, research institutes, and energy companies. The ceremony was held on 29th October in Stara Pazova. Our partners Uroš Popović and Miloš Andrejević had the honor of attending this magnificent event. Leading automotive and battery manufacturers attended the ceremony, confirming the critical role graphene nanotubes play in advancing next-generation battery technologies. “This facility’s strategic location in Serbia will enhance the supply of advanced nanotube solutions across Europe, Asia, and the US,” said Konstantin Notman, CEO of OCSiAl Group. “It will initially produce 60 tons of graphene nanotubes per year; we plan to double this output with a second synthesis unit in the coming year.” In line with OCSiAl’s sustainability goals, the new facility operates entirely on hydroelectric power. Graphene nanotubes contribute directly to a Net Zero future by reinforcing materials to extend product life and by enhancing energy efficiency. Use everything from your closets, unsewn materials and unmade clothing items, to reduce the impact of fashion on the environment - Milica demonstrated with a personal example at this round table because the set she wore was sewn from natural material that was 30 years old. - [Serbia: The second round of auctions for the allocation of market premiums for renewable energy sources](https://d2plaw.com/en/d2p-headlines/serbia-the-second-round-of-auctions-for-the-allocation-of-market-premiums-for-renewable-energy-sources/): The Ministry of Mining and Energy announced on 27 November 2024, the second round of auctions for the allocation of market premiums for renewable energy sources, where investors will compete for the distribution of quotas totalling 424.8 MW. Key Novelties The Ministry of Mining and Energy states that of the total quota offered in the auction, 300 MW are designated for wind power plants, and 124.8 MW for solar power plants. A larger capacity from clean sources that can be secured through these auctions will potentially bring greater electricity production in the country, contributing to higher economic growth and an increase in foreign direct investments. The Ministry also highlights that increasing the share of green energy in the energy mix is crucial for meeting the goals of the green agenda, and its availability is increasingly becoming a requirement for investors looking to invest in Serbia. The maximum bid price in the auction, which is EUR 79 per megawatt-hour for wind power plants and EUR 72 per megawatt-hour for solar power plants, is intended to ensure that the participation of green energy increases at a price that is acceptable for both citizens and the economy. This public call introduces several novelties compared to the previous round of auctions, with the most important being that investors who offer not only the proposed price but also a capacity contract with a guaranteed supplier or end customer, through a power purchase agreement for electricity from renewable energy sources for a period of three to fifteen years, will be given additional priority. This means that investments are further encouraged to ensure that energy produced from domestic, clean sources will be used for the needs of citizens and the economy, thus improving Serbia's energy security. Among other changes, a new limitation has been introduced on the maximum quota for solar power plants in the auctions, which can be allocated to a single auction participant for one or more plants, set at 105 MW. This will ensure equal treatment of smaller producers, and their projects compared to large renewable energy producers. Additionally, the auction rules specify that the offered capacity of the power plant cannot exceed the prescribed quota. It is worth noting that the first auctions, held in August of last year, were extremely successful, as the process was fully digitalized, securing 715 new green MW and over EUR 1.1 billion in investments. The Ministry of Mining and Energy expects strong investor interest in these auctions as well, with the full quota being utilized for both wind and solar energy. In this way, Serbia would be closer to achieving the goal set by the three-year renewable energy incentive plan, which foresees the addition of 1,300 MW of new renewable energy capacity. Cerović added they will all win together if in the following decades they contribute to the creation of a more sustainable and more carbon-neutral society in Serbia. - [Montenegro: New Law on the Use of Energy from Renewable Sources](https://d2plaw.com/en/d2p-headlines/montenegro-new-law-on-the-use-of-energy-from-renewable-sources/): On 17 August 2024, Assembly of the Republic of Montenegro adopted the Law on the Use of Energy from Renewable Sources, which was published in the Official Gazette of Montenegro, issue no. 082/24 (hereinafter: the “Law”). The first law of its kind enacted in Montenegro establishes a solid foundation for encouraging investment in renewable energy sources, with an emphasis on reducing carbon dioxide emissions and increasing the production of energy from clean and sustainable sources. What should be emphasized from the outset is that this Law fully implements EU Directive 2018/2001 on the promotion of the use of energy from renewable sources, thereby achieving complete alignment with these regulations. The Law establishes a comprehensive framework for promoting and regulating renewable energy. It defines the share of renewable energy, offers incentives for production, and outlines the process for obtaining preferential status as a producer. It also mandates issuing guarantees of origin for renewable energy, specifies the roles of buyers, producers, and renewable energy communities, and sets conditions for integrating renewable energy into heating, cooling, and transportation sectors. Additionally, it includes criteria for sustainability and emissions reduction, fosters regional cooperation, and addresses other important aspects of renewable energy utilization. Under the Law, renewable energy sources include non-fossil sources such as wind energy, solar energy (both solar thermal and photovoltaic), geothermal energy, ambient energy, tidal energy, wave energy and other marine energy, hydropower, biomass, landfill gas, gas from wastewater treatment plants, and biogas. This agreement, either in its purpose or effect, has or may have the prevention, restriction, or distortion of competition in the relevant market, directly or indirectly determining purchase or sale prices or other trading conditions. Currently, data, documents, and other relevant information are being collected which may be significant for establishing the factual situation in the aforementioned procedure, and d2p will follow the further course of this procedure. - [The Montenegrin Agency for Protection of Competition issued a Decision in the Case of JUGOPETROL – INA](https://d2plaw.com/en/d2p-headlines/the-montenegrin-agency-for-protection-of-competition-issued-a-decision-in-the-case-of-jugopetrol-ina/): The Montenegrin Agency for Protection of Competition has announced an important decision finding a violation of the Law on Protection of Competition. Below is a summary of the most important positions taken by the Agency in this case: In its decision, the Agency found that the companies "INA – CRNA GORA" LLC BUSINESS COMPANY FOR PRODUCTION, TRADE AND SERVICES PODGORICA and "JUGOPETROL" JOINT STOCK COMPANY FOR EXPLORATION, EXPLOITATION, AND TRADE OF OIL AND PETROLEUM PRODUCTS – PODGORICA, from 8 July 2019, to 31 December 2019, applied a concerted practice of fixed retail prices of liquid petroleum gas on the retail market of liquid petroleum gas in the territory of Montenegro. This agreement aimed at or had the effect of preventing, limiting, or distorting competition, which is contrary to Article 8 of the Law on Protection of Competition. Sanctions: The agreement has been declared PROHIBITED AND VOID and the Agency has instructed both companies to cease further implementation and enforcement of the prohibited agreement. Additionally, the Agency has ordered these companies to submit annual reports to the Agency on the movement of the total quantities of liquid petroleum gas purchased and sold in the previous year, as well as their value. The reasoning of this decision of the Agency has been published in the "Official Gazette of Montenegro" and on the website of the Agency www.azzk.me. - [Montenegro: Amended State Aid Regulation](https://d2plaw.com/en/d2p-headlines/montenegro-amended-state-aid-regulation-2/): The Ministry of Finance of Montenegro recently issued an important regulation that regulates amendments related to the previously valid regulation on state aid matters. Below is a summary of the latest changes: Amendment Regulation on the List of State Aid Rules In order to align Montenegro's regulations with the rules of the European Union, the Ministry of Finance has issued the Amendment Regulation on the List of State Aid Rules. This regulation aims to enhance the control of state aid in accordance with relevant updated EU provisions. Key Novelties: Increase in the Upper Limit of De Minimis Aid One of the key novelties in this regulation is the increase in the upper limit of de minimis aid that a single company can receive per member state in any three-year period. The new limit is EUR 300,000.00, reflecting inflation and estimated trends during the validity period of relevant EU regulations. This increase was necessary to ensure that state aid does not affect trade between member states and does not disrupt market competition. This regulation came into effect on 2 April 2024. The Legal 500 Europe, Middle East & Africa 2024 is now available to view online here. - [CBAM – WHAT DID WE LEARN FROM THE PHASE-IN PERIOD](https://d2plaw.com/en/d2p-headlines/cbam-what-did-we-learn-from-the-phase-in-period/): Background - Paris Agreement & Fit for 55 The Carbon Border Adjustment Mechanism (CBAM) is a crucial part of the EU's efforts to achieve climate neutrality by 2050, aligning with the Paris Agreement's goals. It aims to prevent carbon leakage while encouraging non-EU countries to adopt eco-friendly practices. Endorsed by the European Parliament in March 2021, it seeks WTO compliance and integrates with the EU Emissions Trading System. By adjusting imports based on embedded emissions, it incentivizes global cooperation on climate action. Revenue generated supports both mitigation and adaptation efforts in developing countries, emphasizing international collaboration in tackling climate change. About CBAM The CBAM aligns with EU's international commitments and WTO rules. It mirrors the EU ETS, taxing embedded emissions in imported goods using a methodology consistent with EU ETS reporting. Initially targeting high-risk sectors like iron/steel, cement, and others, it's gradually introduced with a reporting system from October 2023, and financial adjustments start in 2026. This approach aims for legal certainty and dialogue with third countries. Relevant Sectors Criteria by which a specific sector falls under the scope of the CBAM include: relevance of the sector in terms of the quantity of greenhouse gas emissions; exposure of the sector to the risk of carbon leakage; need to balance imported products, in terms of greenhouse gas emissions, with domestic products of the EU. CBAM targets industries like iron, steel, cement, aluminium, hydrogen, and fertilizers due to their high greenhouse gas emissions. Electricity is covered, especially from coal-fired plants. Refinery products and organic-based chemicals are not included currently due to monitoring limitations. CBAM Certificate The CBAM entails – similarly to the system of allowances under the EU ETS – the surrendering of certificates (CBAM certificates) by importers, based on the embedded emission intensity of the products they import in the EU and purchased at a price corresponding to that of the EU ETS allowances at any given point in time. These certificates will not be linked to the EU ETS system of allowances but will mirror the price of these allowances to ensure a coherent approach to the pricing under the EU ETS. Starting January 1, 2026, importers under CBAM must trade certificates to cover embedded emissions. They must purchase enough emission allowances for their imports annually. Importers failing to obtain sufficient certificates may face penalties. Key requirements include calculating direct and indirect CO2 emissions, verifying actual values, obtaining CBAM certificates, and submitting an annual CBAM declaration by May 31 of the following year, comparing imported emissions with acquired allowances. CBAM & EU ETS The CBAM took effect on October 1, 2023, but will be phased in gradually. Initially, a simplified version of the CBAM will apply with reporting obligations only, the aim being to collect data. Starting in 2026, a levy will be imposed on importers of covered goods (which may have been expanded by that time) tied to the weekly average EU ETS allowance price, which, as of December 1, 2022, traded above 80 EUR. Importers must register with the applicable governmental authority and provide periodic reports on imported goods emissions data. Any covered entity that cannot provide the required emissions data calculated in accordance with applicable requirements will be forced to use default values and be subjected to a higher emissions factor, increasing CBAM obligations. Direct emission reporting must be verified by an EU-accredited third party. Functioning of the System Importers bringing goods into the EU must acquire CBAM certificates, reflecting CO2e emissions equivalent to EU production standards. They submit annual reports detailing imported quantities, verified emissions data, and CBAM certificate numbers, deducting any paid carbon taxes. In cases of inadequate data, importers use typical emission values, either from exporting countries or bottom-tier EU facilities. The transitional phase, started October 1, 2023, requires non-EU producers to submit emissions data, which still does not need to be overseen and verified by national accreditation bodies until January 1, 2026. Third Countries and the CBAM In principle, imports of goods from all non-EU countries are covered by the CBAM. However, certain third countries who participate in the EU ETS or have an emission trading system linked to it are excluded from the CBAM, so that a carbon price is not paid twice for the same product. This is the case for members of the European Economic Area (EEA) and Switzerland. The CBAM applies to electricity generated in and imported from third countries including those that wish to integrate their electricity markets with the EU. If those electricity markets are fully integrated and provided that certain strict obligations and commitments are implemented, the concerned countries could be exempted from the CBAM. The European Parliament must now endorse the agreed text, which is considered a formality. The CS3D encompasses due diligence and governance obligations that will have significant impacts on many EU companies and non-EU companies active in the EU, as well as on their value chains worldwide. Background Within the framework of the European Union's ambitious European Green Deal, there has been a pronounced and swift evolution in the realm of corporate sustainability governance within EU legislation. This domain is dedicated to guiding companies in their management of environmental, social, and governance (ESG) concerns. Several significant EU directives have already been enacted in this sphere, notably the Corporate Sustainability Reporting Directive (CSRD) and the Taxonomy Regulation. The CS3D was provisionally agreed upon at a political level in December 2023. The final text of the CS3D must be formally adopted by the European Parliament, and it still awaits formal adoption by the Council of Ministers before it can enter into force. However, this step is typically a formality at this stage. Conclusion The leading Legal Affairs Committee is anticipated to ratify the text in the forthcoming days, preceding a Plenary vote scheduled for April. This accord underscores the imperative for European Union-based enterprises and major multinational corporations operating within Europe to conduct comprehensive due diligence across their entire supply chains, aligning with the stipulations set forth by regulations such as the EU Deforestation Regulation, the EU Forced Labor Regulation, the EU Green Claims Directive, CSRD, and others. The implications of the CS3D will extend significantly to both covered entities and, due to the expansive ramifications of the due diligence and governance mandates on contractual engagements with third parties, to non-covered entities as well. Every enterprise operating within the EU will be compelled to ascertain the applicability of the CS3D to their operations, the requisite information they must furnish, and the adjustments or establishment of processes and procedures necessary for compliance with the CS3D. After all, local realities impact global strategies. Top 3 Global Trends for 2024: Money There are some obvious legislative drivers in the EU with the transposition of the Adequate Minimum Wage Directive and the proposed Pay Transparency Directive, but also remuneration reforms across many of the surveyed jurisdictions in Africa and, more widely, government responses to economic headwinds. A broader analysis of these measures suggests that their effects are largely in favour of the employees, and consequently employers are shouldering the bulk of an even heavier financial burden in 2024. Boosting economic growth through family-friendly measures In 2024 we see a real trend of governments around the globe taking legislative steps to improve family-friendly measures, for both parents and those with caring responsibilities. These measures vary from greater availability of flexible working arrangements, improved maternity, paternity and parental pay, leave and protections, mandatory obligations to provide childcare facilities at or near the workplace, tax breaks for childcare costs, and support for those with caring responsibilities.  The dynamic world of work In 2024 it is evident that working practices and working relationships continue to evolve. The primary objective of the Notice is to align the European Commission's guidance with emerging market dynamic, as well as with advancements in the European Commission's case precedents and European Union jurisprudence. This Notice will bolster transparency and legal clarity for businesses, streamline compliance efforts, and foster more effective competition enforcement. Key elements of the Notice: More accessible guidance General principles Innovation, quality, reliable supply, and sustainability Specific circumstances Dynamic and forward-looking assessments Geographic market definition Quantitative techniques Calculation of market shares Sources of evidence Market definition helps understand the competitive environment in which firms operate, both at a given point in time and more dynamically. Since markets are not static, this analysis needs to be repeated for each case, to take account of changes in production processes, consumer preferences, and other market characteristics, such as innovation cycles, supply chains, the specificities of digital markets and related business models, and ease of access to new suppliers, or in response to regulatory changes. Similarly, the geographical scope of a market is also subject to a fresh assessment in every case, which can lead to markets being defined from local to global, depending on how they work in practice, in particular from the perspective of consumers and customers. For those who could not come or join online, the video is available below. https://youtu.be/qqstiaAAPiA   - [Notice regarding technical issues related to CBAM Transition Registry and Import Control System 2](https://d2plaw.com/en/d2p-headlines/notice-regarding-technical-issues-related-to-cbam-transition-registry-and-import-control-system-2/): Our ESG Department presents an important notice regarding CBAM reporting: Due to technical difficulties experienced by some business entities, preventing them from submitting data and reports related to the EU CBAM and the Import Control System 2, the Commission has introduced a new functionality that will be available from February 1st in the Transition Registry. This functionality allows reporters to submit a "request for deferred submission," providing them with an additional 30 days to submit CBAM reports. According to guidelines provided to National Competent Authorities, no penalties will be imposed on reporters who faced difficulties in submitting their initial CBAM report, which, as a reminder, was due by 31 January 2024. Deferred submission of CBAM reports due to system errors will be considered justified, provided that submission occurs promptly after overcoming technical difficulties. In any case, penalties will not be imposed before the correction procedure is initiated, allowing reporters to provide justifications and rectify any inaccuracies in their CBAM reports. Finally, it should be emphasized that reporting entities can subsequently amend and correct their first three CBAM reports until 31 July 2024. - [Serbia: New immigration (by)laws – new rules as of 1 February 2024](https://d2plaw.com/en/d2p-headlines/serbia-new-immigration-bylaws-new-rules-as-of-1-february-2024/): The amendments of the most significant provisions of the Law on Foreigners and the Law on Employment of Foreigners enter into force today, on 1 February 2024. Simultaneously, on the same day, recently adopted immigration bylaws also come into force: the Rulebook on Issuing a Unified Permit for Temporary Residence and Work of a Foreigner, the Rulebook on Approval of a Temporary Residence and the Rulebook on Electronic Submission of Requests for a Permanent Residence. These immigration bylaws provide a more detailed framework for certain procedures and institutes regulated by the abovementioned laws. With the entry into force of the amendments to the laws, and with the adoption of the relevant bylaws, all formal conditions are now met to achieve the legislative goal primarily reflected in an expedited process of regulating the status of foreigners and their employment, as well as simplifying relevant procedures.
